40th Anniversary Enter-To-Win Terms and Conditions

Contest Official Rules:

1. ELIGIBILITY: Enter-To-Win Contest is open to individual legal U.S. residents who are 21 years of age or older. Central Valley Community Bank employees (and household family members of Bank employees) are not eligible to win. Void where prohibited or otherwise restricted by law. Entrants must “Like” or “Follow” Central Valley Community Bank’s Facebook, Twitter or LinkedIn in order to be entered into the promotion. Memberships on Facebook, Twitter and LinkedIn are free, and registration for can be found online at www.Facebook.com, www.Twitter.com, and www.linkedin.com. You must agree to the Facebook Terms of Service, Twitter Terms of Service and LinkedIn Terms or Service in order to create accounts.
   
   
2. ENTER-TO-WIN CONTEST PERIOD: The Contest starts at 9:30 a.m. PST on 12/01/2020 and ends at 11:59 p.m. PST on 12/31/2020.
   
   
3. HOW TO ENTER:
   1. Via Facebook, Twitter or LinkedIn : Entrants must “Like” Central Valley Community Bank’s Facebook or LinkedIn or “Follow” Central Valley Community Bank on Twitter page. Entrants may only be entered-to-win one time, either on Facebook, Twitter or LinkedIn.
      1. Facebook: During the contest period (December 1, 2020 – December 31, 2020) , comment on one of the Central Valley Community Bank dedicated Enter-To-Win posts and include the hash tag #CVCB40 (which will constitute your entry) in your response. Using the #CVCB40 in your Facebook comment constitutes your consent to these Official Rules. Entrant must like Central Valley Community Bank on Facebook to receive a direct message in the event of prize notification (see section 6 below).
      2. Twitter: During the contest period (December 1, 2020 – December 31, 2020), reply to dedicated Central Valley Community Bank Valley Enter-To-Win Tweets and include the hash tag #CVCB40 (which will constitute your entry) in your response. Using the #CVCB40 in your Tweet constitutes your consent to these Official Rules. Entrant must follow Central Valley Community Bank on Twitter @CVCBNews to receive a direct message in the event of prize notification (see section 6 below).
      3. LinkedIn: During the contest period (December 1, 2020 – December 31, 2020), reply to dedicated Central Valley Community Bank Valley Enter-To-Win posts and include the hash tag #CVCB40 (which will constitute your entry) in your response. Using the #CVCB40 in your LinkedIn comment constitutes your consent to these Official Rules. Entrant must follow Central Valley Community Bank on LinkedIn to receive a direct message in the event of prize notification (see section 6 below).
         
   2. Via Entry Form: If an online entry is not possible, entrants may fill out a paper entry form at a participating Central Valley Community Bank location and give it to a Bank representative.
      
      
4. ENTRY LIMITATIONS: There is a limit of one entry per person. You may enter only once via Central Valley Community Bank Facebook, Twitter or LinkedIn. Each person may only use one Facebook, Twitter or LinkedIn account to participate in the Contest, and such Facebook, Twitter or LinkedIn account must be used by only one person, regardless whether the Facebook, Twitter or LinkedIn account is shared by two or more people. Any entrant who uses more than one Facebook, Twitter or LinkedIn account to enter this Contest may be disqualified and prize won may be forfeited, subject to Central Valley Community Bank’s sole discretion. In case of dispute, the authorized account holder at the time of Contest entry of the Facebook, Twitter or LinkedIn account will be declared the Contest entrant. No mass or mechanically produced entries will be accepted. Proof of submitting an entry does not constitute proof of receipt. All entries become the property of Central Valley Community Bank and will not be returned. Central Valley Community Bank is not responsible for the verification of receipt of any entries. By entering this Contest, you agree to be bound by these rules and the decision of the sponsor, Central Valley Community Bank, which shall be final and binding. All Facebook, Twitter and LinkedIn entries must be received by 11:59 PST on 12/31/2020 to be entered in the Contest.
   
   
5. PRIZE/ODDS: One winner will receive a local restaurant gift card. The gift cad is valued at $50.00. If winner is unable or unwilling to come to branch to pick up prize, Central Valley Community Bank will ship gift card via USPS certified mail. Central Valley Community Bank is not responsible for any notification, documentation or prize that is returned or undeliverable. In the event any documentation or prize is returned as undeliverable, prize will be forfeited. Central Valley Community Bank reserves the right to substitute any stated prize with another prize of equal or greater value. By entering this contest and accepting a prize, winner consents to the use of his/her name, photographs and likenesses for publicity purposes without additional compensation or permission (except where prohibited by law). Actual odds of winning depend on the number of valid entries received.
   
   
6. WINNER SELECTION/NOTIFICATION: One potential prize winner will be randomly selected on 1/4/2021. The drawing will be conducted by Branch Managers whose decisions are final. By 1/5/2021, Central Valley Community Bank will attempt to notify winner by Facebook/Twitter/LinkedIn via Direct Message on chosen platform. If unable to contact winner on the third attempt, that winner therefor forfeits their prize and another winner will be selected at random.
   
   By accepting a Prize – except where legally prohibited you grant permission for Central Valley Community Bank and its designees to use your name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes relating to this Contest, without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. If selected, the winner is responsible for any applicable federal, state and local taxes.
   
   
7. CONTEST LIMITATIONS: Any attempts by an individual to access the Contest technology via a bot script robotic program, macro, script, or other automated means will result in that individual becoming ineligible and such entries disqualified and any prize won will be forfeited. Central Valley Community Bank is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment or software or failure of any e-mail or entry to be received by Central Valley Community Bank on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof – including any injury or damage to participant’s or any other person’s computer related to or resulting from or downloading any materials in this Contest. Central Valley Community Bank, in its sole discretion, reserves the right to suspend, cancel or modify the Contest, or any part of the Contest without notice or liability if the integrity of the Contest is compromised in any manner as determined by Central Valley Community Bank, or if the Contest is not capable of being conducted like intended by Central Valley Community Bank. In such event, Central Valley Community Bank will randomly select winners from among all eligible non-suspect Contest entries received prior to such action. Central Valley Community Bank reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest, or to be in violation of these Official Rules. Any attempt by an entrant or any other individual to deliberately damage, interfere with, or undermine the legitimate operation of this Contest is a violation of criminal and/or civil laws, and should such attempt be made, Central Valley Community Bank reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Under no circumstances will more prizes than those set forth in these full Official Rules be awarded. If a technical error occurs that results in more potential winners than available prizes, Central Valley Community Bank may elect to hold a random drawing from among all eligible non-suspect prize claims received to award the indicated number of prizes. All winners are subject to verification and compliance with these Full Official Rules.
   
   
8. RELEASE OF LIABILITY:
   1. Except where prohibited, all entrants agree to release and hold harmless Central Valley Community Bank and their respective parents, affiliates, subsidiaries, officers, directors, agents, employees, volunteers and all others associated with the development and execution of the Contest, from any and all liability with respect to, or in any way arising from, or in connection with: (a) his/her participation in this Contest and/or the acceptance, possession, or use of any prize that may be awarded to him/her including, but not limited to, liability for personal, bodily injury, death, damages or loss of any kind; (b) unauthorized human intervention in the Contest; (c) technical errors, programming errors, transmission defaults or interruptions related to computers, mobile phones, software, servers, or telephone or network lines; (d) computer server, Facebook failure, Twitter failure, LinkedIn failure, or telephone service failure and/or delayed, garbled or corrupted data transmitted by entrants; (e) seeding, printing or typographical errors; (f) errors in the administration of the Contest or the processing of entries or in sending notifications; (g) late, lost or undeliverable or non-viewable Posts or Tweets, prize awards, e-mail or shipments; or (h) any loss or damage to any entrants or to any other person’s computer or electronic device relating to, or resulting from, playing or downloading any information or software in connection with the Contest. The Related Parties are not responsible for (i) incomplete, lost, illegible, late, non-viewable or misdirected entries and (j) technical, hardware, software or telephone/Internet malfunctions or Facebook/Twitter/LinkedIn malfunctions of any kind, transmission defaults, corrupted data, hardware or software malfunctions, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user, or by any of the equipment or programming associated with or utilized in the Contest, or by any human or other errors that may occur in connection with the Contest.
   2. By accepting a prize, winner acknowledges and agrees that, to the extent allowed by law, Central Valley Community Bank has neither made, nor is in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including without limitation, its quality, mechanical condition or fitness for a particular purpose. Entrants agree that all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and any and all claims, judgments and award shall be limited to actual out-of-pocket costs incurred, excluding attorney’s fees and court costs. UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANTS HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR ANY OTHER DAMAGES WHATSOEVER. IN NO EVENT SHALL SPONSOR BE LIABLE TO ANY ENTRANT OR WINNER FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZE TO BE AWARDED TO THE INDIVIDUAL ENTRANT IN THIS CONTEST. CENTRAL VALLEY COMMUNITY BANK’S FAILURE TO ENFORCE ANY PROVISION IN THESE OFFICIAL RULES WILL NOT BE DEEMED AS A WAIVER OF SUCH. Entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrants rights and obligations, or the rights and obligations of Central Valley Community Bank in connection with the Contest, shall be governed by, and constructed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Fresno, California.
      
      
9. PRIVACY POLICY: Any personally identifiable information collected during this Contest will be collected by Central Valley Community Bank and used by Central Valley Community Bank its affiliates, agents and marketers for purposes of the proper administration and fulfillment of the Contest as described in these Official Rules and in accordance with Central Valley Community Bank’s Privacy Policy as stated at https://www.cvcb.com/privacy and as allowed by law. By participating via the Facebook platform, participants are also subject to Facebook’s Legal Terms located at https://www.facebook.com/legal/terms, and Twitter’s Term of Service located at https://twitter.com/tos, and LinkedIn’s Terms of Service located at https://www.linkedin.com/legal/user-agreement.
   
   
10.
